Deliveries, services and offers from NNG-Marktplatz - www.agroswiss.ch are based exclusively on these terms and conditions, even if they are not expressly agreed again. §3 Prices

§4 Delivery and service time

Dates and delivery periods are non-binding unless otherwise expressly agreed in writing. The specification of specific delivery periods and delivery dates by the NNG marketplace - www.agroswiss.ch is subject to the correct and timely delivery of the NNG marketplace - www.agroswiss.ch by suppliers and manufacturers.

Delivery area: Switzerland and Lichtenstein

Orders from Switzerland and Lichtenstein are usually sent within 24 hours with Swiss Post in practical packaging and PostPac Economy (B Post = CHF 7.00) or PostPac Priority (A Post = CHF 9.00).

§5 Default of Acceptance

If the buyer refuses to accept the delivery items after the expiry of a grace period set for him or declares that he does not want to accept the goods, NNG Marketplace -www.agroswiss.ch refuse to fulfill the contract and claim damages for non-performance. NNG-Marktplatz - www.agroswiss.ch is entitled to demand 15% of the agreed purchase price as damages, but at least CHF 15 as a cancellation fee or to demand compensation for the damage actually incurred from the buyer.

§5-1 Refusal of Acceptance

Delivered goods can no longer be cancelled. If the goods are refused and the goods are not collected, we charge 15% of the invoice amount as a cancellation fee, but at least CHF 15.00 or compensation for the damage actually incurred.

§6 Delivery / return / exchange / right of withdrawal

Visible differences in quantity must be reported in writing to the NNG marketplace - www.agroswiss.ch and the carrier immediately upon receipt of the goods, hidden differences in quantity within 4 days of receipt of the goods. Complaints regarding damage, delay, loss or poor packaging must be reported immediately after receipt of the consignment.

We do not compromise on the quality of the goods we deliver:

  • We grant a right of withdrawal for our deliveries. This expires 14 days after the date of invoicing. In the case of returns, the invoice must be enclosed, otherwise processing is not possible.
  • Any damage during transport must be reported to us within 48 hours. Otherwise the right to a free replacement expires.
  • Returns due to dissatisfaction are excluded.

§7 Transfer of risk

The risk passes to the buyer as soon as the shipment has been handed over to the person carrying out the transport. If shipment is delayed or becomes impossible through no fault of our own, risk passes to the buyer upon notification of readiness for shipment. If NNG-Marktplatz - www.agroswiss.ch agrees to take over the transport costs in individual cases, this has no influence on the transfer of risk.

§8 Warranty

The warranty in accordance with the following provisions is 2 years, unless otherwise expressly agreed in writing. The warranty period begins on the date of delivery. If our operating or maintenance instructions are not followed, changes are made, parts are replaced or consumables are used that do not correspond to the original specifications, any warranty shall be void if the defect is attributable to this. This also applies if the defect is due to improper use, storage and handling of the item, or third-party interference with the item. Insignificant deviations from the guaranteed properties of the goods do not trigger any warranty rights. Liability for normal wear and tear, as well as consumables/accessories/enclosed sponges etc. is excluded. Warranty claims against NNG-Marktplatz - www.agroswiss.ch are only available to the direct buyer and are not assignable.

§9 Returns

For returns, we require that the defective item be sent or delivered to NNG-Marktplatz - www.agroswiss.ch for repair with a copy of the invoice with which the item was delivered. A return of products by the customer requires the prior consent of NNG-Marktplatz - www.agroswiss.ch and is at the customer's expense and risk. The products must be returned in their original packaging and must be accompanied by a detailed description of the fault/defect and a return number. Products that we procure on customer request are excluded from return. The warranty is limited exclusively to the repair or replacement of the damaged delivery items.

§10 Retention of title

The delivered goods remain the property of NNG-Marktplatz - www.agroswiss.ch until full payment has been made.

When purchasing on account, the invoiced amount must be paid to the account of our external partner, swissbilling AG , specified on the invoice by the due date stated on the invoice form at the latest. The payment method purchase on account does not exist for all offers and requires, among other things, a successful credit check by swissbilling AG. If the customer is allowed to purchase on account for certain offers after checking the creditworthiness, the payment is processed in cooperation with swissbilling AG, which takes over the invoice request from the dealer after the conclusion of the purchase contract. Depending on the agreement, invoices are payable by PostFinance, PayPal, credit card, cash on delivery, cash or net within 30 days, unless otherwise agreed. The delivery is generally not free, ie at the expense of the buyer by parcel post, forwarding agent or their own vehicle, unless something else has been expressly agreed. A payment is only deemed to have been made when we can dispose of the amount. If the buyer is in default, we are entitled to charge interest of 5% from the relevant point in time.

§12 Limitation of Liability

Claims for damages due to impossibility of performance, breach of contract, culpa in contrahendo and tort are excluded both against us and against our vicarious agents, unless intentional or grossly negligent action is involved. §13 Copyright / Software Warranty

Insofar as software is part of the scope of delivery, this is made available to the buyer solely for one-time resale or for his own use, ie he may neither copy it nor make it available to others for use.
